The Mediterranean Sea. The word makes you think of sun, beaches, olive trees, and beautiful islands. In recent years, it has also come to be known for less cheerful reasons. The Mediterranean sea, which separates Europe from North Africa and the Middle East, is the most dangerous border crossing in the world. Every year, thousands of people drown trying to cross the sea to Europe. This came to the attention of many Europeans during the ‘refugee crisis’ following the Syrian civil war, but actually the Mediterranean has been one of the most dangerous border crossings for many years. Europe’s economy and refugee protection systems has long drawn people looking for a better life or for protection. The idea that this is a recent phenomenon is mostly based on the media giving it very little attention before 2015 and a lot of attention during and after 2015. However, a lot of Europe’s economy has relied on these people for many years. Farms in Spain and Italy, in particular, rely on undocumented migrant labour to grow and pick the vegetables that end up in our supermarkets. So the Mediterranean sea is one of the most dangerous border crossings in the world. Why is this? It’s not that it’s inherently more dangerous than other border crossings, it’s mostly that European policies make it increasingly dangerous. Since 2015, European border policy in the Mediterranean has mostly been focused on ‘deterring’ migrants from coming. Politicians said that rescuing people in the sea encouraged more people to come, so they started to create policies that made it more difficult for people who made the journey to arrive in Europe. There are several policies they created that achieve this, and these policies achieved their result. They almost doubled the chance of dying on the journey across the Mediterranean. But before we start, let’s talk about migration across the Mediterranean Sea. There are a few different routes that we talk about when we talk about migration across the Mediterranean. One is the Eastern Mediterranean route, from Turkey to Greece. This route became very popular in 2016 when European countries closed the land route from Turkey into Europe, forcing migrants to take the more dangerous sea journey. People crossing at this route mostly come from Iraq, Syria, as well as Iran and Afghanistan. The second is the Central Mediterranean route, the most popular. This route goes from Libya to Italy. It is much longer than the Eastern Mediterranean route, and therefore more dangerous. People coming through this route mostly come from Eritrea, Tunisia, and West African countries. However, more and more Syrians and Asian refugees have used this route since 2016, when European policies shut the Eastern Mediterranean route. The final route is the Western Mediterranean route, from Morocco to Spain. This is also short, and became much more popular when European policies made migration through the other two routes more difficult. It is mostly used by people from Morocco, Cameroon, and West African countries. Okay so now you know who’s migrating and how they’re doing it. So what did Europe decide to do with these desperate people, many of whom were fleeing war and persecution, and the rest hoping for a better life? One of the most shameful European policies is its partnership with Libya. Libya, for anybody who isn’t aware, is basically a failed state right now. It is controlled by militias that are at war with each other. It has no government that controls the entire territory. Migrants are regularly imprisoned, tortured, raped, and killed in terrible ways. Stories came from Libya recently of slave markets selling migrants who were trying to travel through Libya to get to Europe. Almost every respectable human rights organisation in the world has condemned the horror of what is happening to migrants in Libya. So what did Europe do? It teamed up with Libya, of course. The European Union trains Libya’s coast guard. It also funds the Libyan coast guard. They do this because if migrants arrive into European waters, European countries have duties under international law to these migrants. Things like assessing their refugee claims, and ensuring that they don’t drown. However, if they never arrive in Europe, Europe doesn’t have any duties towards them. So they train and fund Libya’s coast guard to make sure that they don’t get into European waters. When European boats patrol Europe’s sea borders, they often patrol with a boat from the Libyan coast guard, so that any migrants they find can be taken back to Libya instead of becoming the responsibility of Europe. This essentially means that European policy towards migrants in the Mediterranean is to actively ensure that they stay in a country where they are aware that they will be imprisoned, tortured, raped, and sold into slavery. Teaming up with the Libyan coast guard is one of the most horrendous European migration policies, in my opinion. It completely undermines international law and human rights law basically by making sure that the duties that it assigns to signatories of conventions never arise because migrants are not allowed to reach European jurisdictions. Another policy that many countries brought in was the criminalisation of NGO rescue missions. In order to get to Europe, migrants pay smugglers. Sometimes, these are cousins or entrepreneurial young men who buy a boat and sell spaces on the boat for migrants, and then use it to go to Europe too. Sometimes, they are organised criminals who have many boats, and many networks that allow them to operate. These smugglers used to use good wooden boats that were quite safe. But then the European Union started to undermine their business model by burning their boats after rescuing migrants, so that they couldn’t be reused by smugglers. In order to continue making profits, smugglers started to use cheaper and cheaper boats, making the crossing more and more dangerous. Smugglers usually just push the boats in the direction of Europe and turn on the motor, asking one of the migrants to steer. The boats are usually not made for such crossing the open sea, and many of them start to struggle before they arrive on land. The smugglers rely on coast guards rescuing the migrants. Under international law, countries have a duty to rescue people who are in danger in their sea. However, countries started to ignore this duty after 2015, ignoring signals of boats in distress. There are some stories of coast guards pushing boats back into Libyan waters, illegally. They also started to make it difficult for other people to rescue them. Migrants were often rescued by boats funded by non-governmental organisations. In some countries, this is not protected by law. There are laws that make it illegal to smuggle undocumented migrants into the country. Some countries make exceptions for humanitarian organisations saving people from dying in the sea, but many countries do not, or don’t make a clear exception, meaning that they can choose to arrest humanitarian workers under these laws. This makes it very difficult for these organisations to work, and since the refugee crisis, European countries are arresting more people for rescuing migrants in the sea. The policies of the European Union allow this. Many migrants are also rescued by passing ships, who are travelling for other reasons. Captains who could not watch people drowning ordered them to be rescued. However, European countries also made this more difficult by refusing these boats permission to land on their shores. These boats were sometimes stuck for weeks at sea, unable to land anywhere with their ship full of undocumented migrants. This made life very difficult for kind captains who could not allow human beings to drown in front of their eyes. It was a policy that discouraged this kind of kindness at sea. The criminalisation of NGOs rescuing migrants and kind captains who could not pass by while people were dying was mostly a state-by-state affair. However, it was partially the result of one of the European Union’s worst policies: The Dublin Regulation. The Dublin Regulation is quite simple. It basically says that asylum seekers must apply for asylum in the first European country they arrive in. Practically speaking, this means the first European country they are registered in. If you picture a map of Europe in your head, you will realise that there are only some European countries that asylum seekers will arrive in (except for those who arrive by plane, which is rare but does happen). These countries are the ones at Europe’s edges: Spain, Italy, Greece, Bulgaria, Hungary. These countries, especially the Eastern European countries, are the poorest in Europe. Spain, Italy, and Greece had economies that were devastated by the 2008 crisis, and the austerity policies that European institutions forced on them. They did not have the resources or the institutions to house, feed, and examine the asylum claims of all of the people who arrived in 2015. To be a migrant in Italy during the refugee crisis was a horrific experience. European courts stopped countries returning migrants to Greece and Italy because of the breaches of human rights that migrants experienced there. The unfairness of putting the cost of asylum procedures on the poorest countries of the EU meant that these procedures also became unfair. In 2016, only 1.7% of Afghan asylum seekers were granted refugee status in Bulgaria, but 97% of them were granted refugee status in Italy. At the same time, European countries started to put more effort into returning rejected asylum seekers to their countries of origin.
